2. Scope
These Terms and Conditions of Sale apply to all orders for food products and delivery services placed with Breakfast Time, whether directly via our website or via our partner platforms.
3. Products and availability
Our products are fresh food items prepared the same morning. They are available Monday to Sunday from 7am to 3pm, subject to availability. Breakfast Time reserves the right to modify its menu at any time.
4. Orders and confirmation
Any order placed on our site or via our partner platforms constitutes acceptance of these Terms and Conditions. The order is confirmed upon receipt of a confirmation email or notification.
5. Prices and payment
All prices are displayed in euros inclusive of all taxes. Breakfast Time reserves the right to modify its prices at any time. Payment is due at the time of ordering.
6. Delivery
Delivery is provided across the Alpes-Maritimes. Delivery times are indicative and Breakfast Time cannot be held liable for delays due to external circumstances (traffic, weather, etc.).
7. Right of withdrawal
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for orders of perishable food products or for services provided on a specific date or with a specific frequency. Accordingly, any confirmed order is final and binding.
8. Orders via partner platforms
Orders placed via partner platforms such as Uber Eats or Deliveroo are subject to the terms and conditions of those platforms. Accordingly, the terms of cancellation, modification and refund are defined exclusively by those platforms.
9. Complaints
Any complaint relating to an order must be submitted within 24 hours of delivery to: contact@breakfast-time.fr. We undertake to respond as quickly as possible.
10. Applicable law
These Terms and Conditions are governed by French law. In the event of a dispute, an amicable solution will be sought as a priority. Failing that, the competent courts of the Antibes jurisdiction shall have sole jurisdiction.
